Terms of Service

Please read these Terms of Service ("Terms") carefully before using Brutal.

Welcome, and thank you for your interest in Mulholland, Inc. ("Mulholland," "we," "us," or "our") and our mobile application Brutal, along with any related websites or services we provide (collectively, the "Service"). These Terms constitute a legally binding agreement between you and Mulholland governing your access to and use of the Service.

IMPORTANT NOTICE REGARDING DEVICE RESTRICTIONS: Brutal is intentionally designed to restrict access to certain applications and features on your mobile device for a defined period. By using the Service, you acknowledge and agree to this core functionality. Please read Section 4 carefully.

ARBITRATION NOTICE: Except for certain disputes described in Section 13, you agree that disputes arising under these Terms will be resolved through binding, individual arbitration. BY ACCEPTING THESE TERMS, YOU AND MULHOLLAND ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING. You may opt out of arbitration within 30 days as described in Section 13.3.

1. Service Overview

Brutal is a productivity and focus tool that enables users to voluntarily restrict access to selected applications on their mobile device for a user-defined period. The Service utilizes Apple's Screen Time / Family Controls APIs to enforce these restrictions locally on your device.

The Service includes Unlock Credits — consumable digital goods that grant you the option to end a focus session early if you choose. Unlock Credits are included with your subscription and may also be purchased separately.

THE SERVICE IS PROVIDED FOR PRODUCTIVITY AND FOCUS PURPOSES ONLY. WE DO NOT WARRANT THAT THE SERVICE WILL IMPROVE YOUR PRODUCTIVITY, REDUCE SCREEN TIME, OR ACHIEVE ANY PARTICULAR OUTCOME.

2. Eligibility

You must be at least 18 years old to subscribe to the Service or purchase Unlock Credits. Users between the ages of 13 and 17 ("Minor Users") may use the free features of the Service only with the consent and supervision of a parent or legal guardian ("Guardian"). Minor Users may not make purchases. Guardians are responsible for all activity by Minor Users.

By agreeing to these Terms, you represent and warrant that: (a) you are at least 18 years old if subscribing or making purchases, or at least 13 years old with Guardian consent for free features; (b) you have not previously been suspended or removed from the Service; and (c) your use of the Service complies with all applicable laws.

3. Accounts

To access certain features of the Service, you must register for an account. You agree that the information you provide is accurate and that you will keep it up to date. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account, including all use of Unlock Credits. If you believe your account has been compromised, notify us immediately at support@mulholland.ai.

4. Device Restriction and Assumption of Risk

By using Brutal, you acknowledge and agree to the following:

5. Subscriptions, Unlock Credits, and Early Unlock

5.1 Subscription Service

The Service is offered on a subscription basis. Your subscription grants you access to the Service's features and includes a monthly allotment of Unlock Credits. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your Apple ID account settings or by contacting support@mulholland.ai.

5.2 What Are Unlock Credits

Unlock Credits are consumable digital goods that grant you the option to end a focus session early. They represent access to an optional feature — the ability to remove device restrictions before a session's scheduled end time. Unlock Credits are consumed only if and when you choose to use them.

5.3 How Unlock Credits Work

Before starting a focus session, you select an Unlock Credit value from the available options. This determines which credit will be consumed if you choose to unlock early.

5.4 Monthly Subscription Credits

Your subscription includes a monthly allotment of Unlock Credits. Subscription credits reset at each billing cycle and do not roll over. Unused subscription credits at the end of a billing period are forfeited. This is not a penalty — it is simply how the monthly allotment works, similar to data plans or other subscription allowances.

5.5 Purchased (Top-Up) Credits

You may purchase additional Unlock Credits at any time via Apple In-App Purchase. Purchased credits persist until used and do not expire at the end of a billing cycle. When you unlock early, subscription credits are consumed first before purchased credits.

5.6 Unlock Credits Are Non-Refundable

Once an Unlock Credit is consumed, it cannot be restored or refunded. You acknowledge that: (a) Unlock Credits are consumable digital goods; (b) you choose whether and when to use them; (c) you must confirm before consumption; and (d) the early unlock feature is delivered immediately upon your confirmed choice. Refunds are not available except as required by applicable law.

5.7 Payment Processing

All subscription fees and Unlock Credit purchases are processed through Apple In-App Purchase. Mulholland does not directly store or process your payment information. Pricing is displayed in the app before any purchase.

6. License

Subject to your compliance with these Terms, Mulholland grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Service on a device you own or control, solely for personal, non-commercial purposes. You may not reverse engineer, decompile, or attempt to circumvent any security features of the Service.

7. Prohibited Conduct

You agree not to: (a) use the Service for any illegal purpose; (b) attempt to bypass, circumvent, or exploit the locking mechanism without using an Unlock Credit; (c) interfere with security features; (d) use automated means to access the Service; (e) impersonate any person or entity; (f) sell, transfer, or gift your account or Unlock Credits to any third party; (g) exploit any bug or error to obtain Unlock Credits without payment; or (h) assist others in any of the foregoing. We may suspend or terminate accounts that violate these Terms.

8. Ownership

The Service and all Materials (interfaces, graphics, code, and content) are owned by Mulholland or its licensors and protected by intellectual property laws. These Terms grant you no rights to use Mulholland's trademarks or branding.

9. Term and Termination

Term: These Terms are effective when you accept them or first use the Service.

Termination by Mulholland: We may suspend or terminate your access at any time, with or without cause or notice.

Termination by You: You may terminate by cancelling your subscription, deleting the app, and contacting support@mulholland.ai to request account deletion.

Effect of Termination: Upon termination, your license ends, any unused Unlock Credits (both subscription and purchased) are forfeited, any active session restrictions will remain until their scheduled end time, and Sections 4, 5.6, 8, 10, 11, 12, 13, and 14 survive.

10. Indemnification

You agree to defend, indemnify, and hold harmless Mulholland and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service, your use of Unlock Credits, violation of these Terms, or violation of any third-party rights.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." MULHOLLAND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT THE LOCKING MECHANISM WILL BE IMPENETRABLE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MULHOLLAND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING ANY UNLOCK CREDITS YOU CHOOSE TO CONSUME. OUR AGGREGATE LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF (A) $100 OR (B) THE AMOUNTS YOU PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM.

13. Dispute Resolution and Arbitration

13.1 Agreement to Arbitrate

You and Mulholland agree that any dispute arising from these Terms or the Service, including disputes related to Unlock Credits, will be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court.

13.2 Exceptions

Either party may: (a) bring claims in small claims court if eligible; (b) seek injunctive relief in court for intellectual property infringement; or (c) pursue enforcement actions through applicable agencies.

13.3 Opt-Out

You may opt out of arbitration within 30 days of accepting these Terms by sending written notice to: Mulholland, Inc., Attn: Legal – Arbitration Opt-Out, 9062 Rosecrans Ave., Bellflower, CA 90706. Include your name, email, and a statement that you wish to opt out.

13.4 Pre-Arbitration Notice

Before filing arbitration, the complaining party must send a written Notice of Dispute by certified mail describing the claim and requested relief. The parties will attempt to resolve the dispute for 30 days before proceeding.

13.5 No Class Actions

YOU AND MULHOLLAND AGREE THAT EACH MAY BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any class proceeding unless both parties agree in writing.

14. General Provisions

Governing Law: These Terms are governed by California law. Exclusive jurisdiction lies in Los Angeles County courts.

Modifications: We may modify these Terms by posting updates. Material changes take effect 30 days after posting for existing users. Continued use constitutes acceptance.

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Mulholland.

Severability: If any provision is unenforceable, the remainder stays in effect.

Assignment: You may not assign these Terms. We may assign them freely.

Waiver: Failure to enforce any provision is not a waiver of that provision.

15. Apple-Specific Terms

These Terms are between you and Mulholland only, not Apple. Apple has no obligation to provide maintenance or support. Apple is not responsible for product liability, legal compliance, or intellectual property claims related to the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
